Terms and Conditions for Sales of Stone Cleaning Products and Equipment

 

These terms and conditions (“Terms and Conditions”) govern the sale of stone cleaning products and equipment (“Products”) by First Line London Ltd, trading as Stone Rescue (“Stone Rescue”, “We”, “Us” or “Our”) to you, the customer (“You” or “Customer”). By purchasing Products from Stone Rescue, you agree to be bound by these Terms and Conditions.

  1. Ordering and Acceptance

1.1 Orders for Products may be placed online, by email, or over the phone. By placing an order, you agree to be bound by these Terms and Conditions.

1.2 Acceptance of your order and the formation of a contract between you and Stone Rescue shall occur when Stone Rescue issues an order confirmation or when the Products are dispatched, whichever occurs first.

  1. Pricing and Payment

2.1 All prices for Products are exclusive of VAT and are subject to change without notice. We reserve the right to correct any errors or omissions in pricing at any time.

2.2 Payment for Products must be made in advance by an accepted method of payment, including credit card, debit card, or bank transfer.

  1. Delivery

3.1 Stone Rescue only delivers Products within England and Wales. For deliveries outside of this area, a custom rate based on the destination will be provided upon request. Please contact us for a quote at gabriel@firstline.london.

3.2 A flat shipping rate of £11.75 will be applied to orders with a total value of less than £120. Shipping is free for orders with a total value greater than £120.

3.3 We will use reasonable efforts to deliver Products within the estimated delivery times, but we cannot guarantee delivery dates. We shall not be liable for any delays in delivery or failure to deliver due to circumstances beyond our reasonable control.

  1. Inspection and Acceptance of Products

4.1 Upon receipt of the Products, you must inspect them promptly. Any claims for damaged, defective, or missing Products must be reported to Stone Rescue within 48 hours of delivery.

4.2 If you do not report any issues with the Products within 48 hours of delivery, the Products shall be deemed accepted and in conformity with the order.

  1. Returns and Refunds

5.1 You may return Products for a refund or exchange within 14 days of delivery, provided that the Products are unused, in their original packaging, and in the same condition as when they were received.

5.2 To initiate a return or exchange, you must contact Stone Rescue for a Return Merchandise Authorization (RMA) number and return shipping instructions.

5.3 You are responsible for the cost of return shipping, and you assume the risk of loss or damage to the Products during return shipment.

5.4 Refunds or exchanges will be processed within 14 days of Stone Rescue’s receipt of the returned Products, subject to inspection and approval.

  1. Warranty and Limitation of Liability

6.1 Stone Rescue warrants that the Products will be free from defects in material and workmanship for a period of 12 months from the date of delivery, unless otherwise specified in the manufacturer’s warranty.

6.2 To the extent permitted by law, Stone Rescue’s liability for any breach of warranty or other claim arising from the sale of Products shall be limited to the repair or replacement of the defective Products, or, at Stone Rescue’s discretion, a refund of the purchase price.

6.3 In no event shall Stone Rescue be liable for any indirect, incidental, consequential, or special damages arising from the sale or use of the Products, including but not limited to loss of profits or business interruption, even if Stone Rescue has been advised of the possibility of such damages.

  1. Miscellaneous

7.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

7.2 No waiver of any provision of these Terms and Conditions shall be deemed a further or continuing waiver of such provision or any other provision, and Stone Rescue’s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.

7.3 If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent possible, and the remaining provisions of these Terms and Conditions shall continue in full force and effect.

7.4 These Terms and Conditions, together with any order confirmation, constitute the entire agreement between you and Stone Rescue with respect to the sale of Products and supersede all prior or contemporaneous understandings, agreements, or representations, whether written or oral, relating to the subject matter herein.

7.5 You may not assign or transfer your rights or obligations under these Terms and Conditions without the prior written consent of Stone Rescue.

7.6 Any notice required or permitted to be given under these Terms and Conditions shall be in writing and shall be deemed to have been duly given when delivered in person, sent by registered mail, or sent by email to the addresses specified in the order confirmation or such other address as either party may designate in writing from time to time.

7.7 Nothing in these Terms and Conditions shall create or be deemed to create a partnership, joint venture, or agency relationship between the parties.

7.8 These Terms and Conditions may be amended or modified by Stone Rescue from time to time. Any such amendment or modification shall be effective upon written notice to you. Your continued purchase of Products following such notice shall constitute your acceptance of the amended or modified Terms and Conditions.

7.9 In the event of any inconsistency or conflict between these Terms and Conditions and any order confirmation, the provisions of these Terms and Conditions shall prevail to the extent of the inconsistency or conflict.

7.10 You acknowledge and agree that any Products purchased from Stone Rescue are intended solely for your use and may not be resold, redistributed, or otherwise provided to any third party without the prior written consent of Stone Rescue.

7.11 Both parties agree to comply with all applicable laws, rules, and regulations in connection with the purchase, sale, and use of the Products, including but not limited to health and safety regulations and environmental protection legislation.

7.12 You shall be responsible for obtaining any permits, licenses, or authorizations required for the use of the Products in your jurisdiction.

7.13 Any delay or failure by Stone Rescue to exercise any right or remedy provided under these Terms and Conditions or by law shall not constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.

7.14 In the event that any provision of these Terms and Conditions is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

7.15 Force Majeure: Neither party shall be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is due to any cause beyond the reasonable control of that party, including but not limited to acts of God, war, terrorism, civil unrest, strikes, lockouts, or other industrial disputes, failure of utility services, or breakdown of communication or transportation systems. In such circumstances, the affected party shall be entitled to a reasonable extension of time for the performance of its obligations.

7.16 Third Party Rights: Except as expressly provided in these Terms and Conditions, a person who is not a party to these Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any term of these Terms and Conditions.

7.17 Severability: If any provision of these Terms and Conditions is held to be invalid or unenforceable by any competent authority or court, such invalidity or unenforceability shall not affect the enforceability of the remaining provisions, which shall remain in full force and effect. If any provision of these Terms and Conditions is so found to be invalid or unenforceable but would be valid or enforceable if some part of the provision were deleted, the provision in question shall apply with the minimum modifications necessary to make it valid and enforceable.

7.18 Counterparts: Any order confirmation and any amendments thereto may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

7.19 Dispute Resolution: In the event of a dispute arising out of or in connection with these Terms and Conditions, including any question regarding their existence, validity, or termination, the parties shall first attempt to resolve the dispute amicably through good faith negotiations. If the dispute cannot be resolved amicably within thirty (30) days of the dispute being raised by either party, either party may refer the dispute to arbitration in accordance with the Arbitration Act 1996 or any statutory modification or re-enactment thereof for the time being in force. The seat of arbitration shall be in London, England, and the arbitration shall be conducted in the English language. The decision of the arbitrator(s) shall be final and binding on the parties.

By purchasing Products from First Line London Ltd t.a. Stone Rescue, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including any amendments or modifications made thereto from time to time.
